Terms of Service

These terms are subject to change. Continued use of the service after a change takes effect means you accept the updated terms.

1. Introduction

These Terms of Service (the “Terms”) govern your use of the eXpertVal service operated by eXpertVal Ltd (referred to as “eXpertVal”, “we”, “us” or “our”). By creating an account or using the service, you agree to be bound by these Terms. If you don’t agree, don’t use the service.

These Terms are written in plain English. Where legal terminology is necessary, it has its ordinary legal meaning under the law of England and Wales.

2. The service

eXpertVal is an AI-powered property valuation tool built for estate agents. The service provides each subscribed agent with:

  • A branded valuation page hosted on a subdomain that you choose
  • Automated property valuations generated by an AI model, drawing on UK Land Registry data, PropertyData listings, and other sources
  • A lead-capture pipeline that delivers homeowner enquiries to your dashboard and inbox
  • A homeowner nurture sequence sent in your name and reply-to
  • An agent dashboard for reviewing leads, configuring branding and managing your account

The service is provided on a software-as-a-service basis. We may add, change or remove features from time to time, generally to improve the service. Where a change materially reduces functionality, we’ll give you reasonable advance notice.

3. Eligibility and your account

To create an account you must be at least 18 years old and have legal authority to enter into these Terms, either on your own behalf or on behalf of the estate agency you represent. By signing up you confirm that you are acting in the course of a business and not as a consumer.

You’re responsible for keeping your login credentials confidential and for all activity that takes place under your account. Let us know straight away if you suspect any unauthorised use. You may not share your account with anyone outside the estate agency you signed up on behalf of.

4. Acceptable use

When you use the service, you agree not to:

  • Use the service for any unlawful, fraudulent or harmful purpose
  • Misrepresent who you are, who you work for, or the source of any valuation
  • Send leads, contact details or marketing communications to homeowners who have not consented or who have unsubscribed
  • Attempt to reverse engineer, scrape, harvest or otherwise extract data from the service in bulk
  • Use the service to compete with us by building a substantially similar product
  • Interfere with the security, integrity or performance of the service or any other user’s use of it
  • Upload content that is defamatory, infringing, obscene or otherwise unlawful

We may suspend or terminate your account if we reasonably believe you have breached these acceptable-use rules.

5. Pricing and payment

The standard pricing for the service is £20 per month (paid monthly) or £160 per year (paid annually, equivalent to four months free). All prices are exclusive of VAT, which will be added at the prevailing rate where applicable.

Payments are taken by our payment processor (Stripe). By providing payment details you authorise us to charge the applicable fees on each renewal until you cancel. Failed payments may result in suspension of the service until the balance is settled.

We may change our prices from time to time. For monthly subscribers, any price change will take effect at the start of the next monthly billing cycle and we’ll give you at least 30 days’ notice. Annual subscribers keep the price they paid until renewal.

6. Free trial

New accounts may start with a 3-month free trial, with no card required upfront. At the end of the trial we’ll email you. If you choose to continue, you pick a monthly or annual plan and add a card. If you don’t, your account is paused. Paused accounts retain existing leads in the dashboard but stop accepting new valuations through your branded page.

We reserve the right to limit the trial to one per agent and one per agency, and to withdraw or modify the trial offer for new sign-ups at any time. Existing trials are honoured for the period they were granted.

eXp UK agents who sign up with an @expuk.com email address may be eligible for an extended free period for the duration of their tenure with eXp UK, subject to separate arrangements between eXpertVal and eXp UK.

7. Cancellation and refunds

You can cancel a monthly subscription at any time from your account settings. The cancellation takes effect at the end of the current monthly billing period. You keep access to the service until then. We do not provide pro-rata refunds for partial months.

Annual subscriptions are a one-off upfront payment. There’s no recurring charge to cancel; the subscription simply doesn’t renew at the end of the year unless you take action. We do not provide refunds for annual subscriptions except where required by law (for example, in the first 14 days where statutory cancellation rights apply and you have not made material use of the service).

On cancellation, you can export all of your leads to CSV before your access ends. We retain account data in line with the retention rules in our Privacy Policy.

8. Termination by us

We may suspend or terminate your account, with reasonable notice where practical, if:

  • You materially breach these Terms, including the acceptable-use rules
  • You fail to pay fees when due and do not remedy the failure within a reasonable period after notice
  • We are legally required to do so
  • We discontinue the service or a feature you rely on, in which case we’ll give at least 60 days’ notice and refund any unused portion of an annual subscription

9. Valuation accuracy and no warranty

Please read this section carefully. It limits the accuracy guarantees on AI-generated valuations.

The valuations produced by eXpertVal are automated estimates. They are derived from publicly available data, comparable sales and AI reasoning, and they are intended as an indicative guide only. They are not a professional valuation, a RICS Red Book valuation, a market appraisal carried out by a qualified surveyor or an estate agency instruction.

You agree that:

  • Valuations may be inaccurate, sometimes materially so
  • You will not represent to homeowners that an eXpertVal valuation is a professional valuation, a definitive market price or a guarantee of sale price
  • You remain professionally responsible for any advice you give to homeowners based on the valuation
  • We make no warranties or representations, express or implied, regarding the accuracy, completeness, fitness for purpose or merchantability of valuations or any other output of the service

Except as expressly stated in these Terms, the service is provided “as is” and “as available”. All implied terms, conditions and warranties that can be excluded under English law are excluded.

10. Limitation of liability

Nothing in these Terms limits any liability that cannot be limited under English law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982.

Subject to that, our total aggregate liability to you under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is capped at the total fees you have paid to us in the twelve (12) months preceding the event giving rise to the claim.

We are not liable for any of the following types of loss, whether direct or indirect: loss of profits, loss of business, loss of goodwill, loss of anticipated savings, loss of opportunity, loss of revenue, or loss of data, except where such loss is a direct and reasonably foreseeable consequence of our breach.

In particular, we are not liable for any loss arising from your reliance on a valuation produced by the service, including any loss arising from a property selling at a price below the estimated range.

11. Indemnification

You agree to indemnify and hold us harmless against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the service, your breach of any law, or any content you upload or communications you send through the service.

12. Intellectual property

We retain all intellectual property rights in the eXpertVal service, software, valuations methodology, brand and documentation. You receive a limited, non-exclusive, non-transferable licence to use the service during the term of your subscription.

You retain all rights in the content you upload (your profile, branding, photo, lead data, etc.). You grant us a licence to host, process and display that content as necessary to deliver the service.

The leads you collect through the service are yours. You can export them at any time. We do not claim ownership over your lead data, and we will not use it for any purpose other than delivering the service to you.

13. Data protection

How we handle personal data is set out in our Privacy Policy, which forms part of these Terms by reference. You agree that when you collect homeowner data through your branded page, you are the data controller for that data and we act as a data processor on your behalf.

You are responsible for ensuring that your collection and use of homeowner data complies with UK GDPR and the Data Protection Act 2018, including providing homeowners with appropriate privacy information and obtaining any consents required.

14. Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top of this page shows when the most recent change was made. For material changes (for example, to liability, pricing, or your rights), we’ll notify account holders by email at least 14 days before the change takes effect.

Continued use of the service after a change takes effect means you accept the updated Terms. If you don’t accept a change, you can cancel under section 7.

15. Governing law and disputes

These Terms are governed by the law of England and Wales. Any dispute arising out of or in connection with these Terms or your use of the service is subject to the exclusive jurisdiction of the courts of England and Wales.

Before starting court proceedings, we both agree to attempt to resolve the dispute in good faith, by email or phone, for at least 30 days.
